Terms of Service

1. The service

DigiGrowth is marketing automation software. It helps you organise contacts, prepare campaigns, request approvals, and send email to people you have a lawful basis to contact. You access it through a workspace that belongs to you.

2. Your account

You are responsible for activity in your workspace and for keeping your sign-in credentials secure. New accounts are reviewed before access is granted. We may suspend an account that is used unlawfully or that puts the service or other customers at risk.

3. Your data and your contacts

You keep ownership of the data you put into DigiGrowth, including your contact records and campaign content. You grant us permission to process that data only in order to provide the service to you.

You are the controller of your contacts’ personal data and we act as your processor. You confirm that you have a lawful basis — consent or another valid ground — to contact every person you upload, and that you will honour unsubscribe requests. DigiGrowth records opt-in state and suppresses unsubscribed and bounced addresses, but the responsibility for lawful contact is yours.

4. Acceptable use

Do not use DigiGrowth to send unsolicited bulk email, to harass anyone, to impersonate a person or organisation, to distribute malware, or to break any law that applies to you or your recipients.

5. Plans, billing and cancellation

Paid plans are billed monthly in advance through Stripe. Plan limits are listed on the pricing page. You can cancel at any time; cancellation takes effect at the end of the paid period and we do not refund part-months unless the law requires it. We will give notice before changing prices.

6. Availability

We work to keep DigiGrowth available but we do not promise uninterrupted service. Maintenance, third-party outages, and provider limits can affect delivery. Where the service depends on an external platform (for example an email provider or a social network), that platform’s own rules and limits apply.

7. Liability

To the extent the law allows, DigiGrowth is provided “as is”, and our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim. We are not liable for lost profits or indirect loss. Nothing here limits liability that cannot lawfully be limited.

8. Ending the agreement

You may stop using the service at any time. We may end or suspend access if these terms are breached. On termination you can export your data for a reasonable period, after which we may delete it.
